1. Agreement to Terms

By accessing or using the Recess website (recessaz.com) and related services, operated by Tempe Axe LLC ("we," "us," or "our"), you agree to be bound by these Terms & Conditions. You must be at least 18 years old to use this site. We reserve the right to modify these terms at any time, with notice provided by updating the "Last Updated" date.

2. Bookings & Payments

All reservations are processed via Zapbook and/or Checkfront, third-party booking platforms.
Payments are securely processed through Square and Toast.
By booking, you also agree to any applicable third-party terms.

Cancellation Policy

A minimum of 7 days' notice is required to cancel or reschedule.
If canceled 7 or more days in advance, the deposit may be refunded or transferred.
If canceled fewer than 7 days in advance, the deposit is forfeited.

3. Intellectual Property

All site content — including source code, databases, designs, audio, video, text, photographs, and graphics — is the proprietary property of Tempe Axe LLC or its licensors. You are granted a limited license to access and download content for personal, non-commercial use only.

4. Required On-Site Waiver

Participation in activities requires signing a mandatory liability waiver on-site.
Failure to sign means no participation and no refund.
The waiver governs all risks associated with participation.

This includes risks such as:

Serious injury, disability, or death
Equipment-related hazards (axes, games)
Alcohol-related risks
Release of liability and agreement not to sue

5. Assumption of Risk

By entering the premises, you acknowledge:

Activities involve inherent and unpredictable risks
You voluntarily assume all risks associated with participation

6. Prohibited Activities

You agree not to:

Use automated tools or scripts to access the site
Engage in data scraping, fraud, or security circumvention
Harass, spam, or impersonate others
Reverse engineer site code or use the site for unauthorized commercial purposes
Engage in unsafe, reckless, or disruptive behavior on premises
Damage property or equipment

7. Alcohol Policy

The legal drinking age in Arizona is 21 years old.
We require valid government-issued ID for alcohol service.

Minor Access

Certain hours and areas are 21+ only.
Minors may be permitted during designated hours with adult supervision.
We reserve full discretion to restrict access or remove underage guests from bar areas.

8. Responsible Drinking

By consuming alcohol:

You confirm you are 21 or older.
You agree to drink responsibly.
We may refuse service or remove intoxicated guests.

9. SMS, Messaging & Communications

By submitting a form, booking, or contacting us:

You consent to receive transactional messages (booking confirmations, responses) and promotional messages (if opted in).
Message frequency varies. Message and data rates may apply.

Opt-Out

Reply STOP to unsubscribe at any time. We comply with TCPA (U.S. texting laws) and opt-in/opt-out requirements.

10. User Contributions & Submissions

Any content you submit (reviews, photos, feedback) grants Tempe Axe LLC an unrestricted, perpetual, royalty-free license to use such content across all media formats. All submissions become the property of the company.

11. Third-Party Services

We are not responsible for failures or issues caused by:

Zapbook / Checkfront (booking systems)
Square / Toast (payment processing)
GoHighLevel (CRM/messaging)

We are also not responsible for external websites or third-party content linked from our site.

12. Disclaimer

The site and services are provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind. Tempe Axe LLC disclaims all warranties, express or implied, regarding accuracy, merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Tempe Axe LLC is not liable for:

Injuries (covered further in your signed waiver)
Lost or stolen property
Third-party system issues
Data loss or corruption
Indirect, incidental, or consequential damages

14. Indemnification

You agree to defend and hold harmless Tempe Axe LLC from any claims arising from your use of the site, contributions, violations of these terms, or harmful acts toward other users.

15. Media Release

By entering the premises, you consent to photography, video recording, and use of your likeness for marketing purposes (as also stated in your waiver).

16. Right to Refuse Service

We reserve the right to deny entry, suspend or cancel activities, remove any guest, or terminate accounts at our discretion, for any reason, without notice.

17. Governing Law & Arbitration

These Terms are governed by the laws of the State of Arizona. Any disputes arising from bookings, website use, or participation in activities will be resolved by binding arbitration in Arizona.

No class actions
Each party bears its own legal fees
Arbitration governed by Arizona law

18. Modifications

We may change, modify, or discontinue the site or these terms without notice or liability.
